Pre-Suit Attorney

Groth, Makarenko, Kaiser and Eidex
Duluth, GA

About The Role

As an Associate Attorney in our growing Pre Litigation Time-Limited Demand group, you will handle fast-moving pre-suit settlements at scale, focusing on time-limited demands, proactive tenders, and global settlements. Instead of juggling depositions and trial prep, you’ll analyze cases, assess risk, and craft strategic demand responses—playing a direct role in protecting clients while keeping cases moving. You will have the best of both worlds: the ability to practice law, negotiate settlements, and make real decisions that impact high-value claims—without having to set foot in a courtroom. You will also assist clients in proactive settlements, working on global resolution of cases, assisting with minor settlements and advising clients on risk.

A high number of candidates may make applications for this position, so make sure to send your CV and application through as soon as possible.

Responsibilities

  • Review, analyze, and triage incoming settlement demands, meeting due dates and material terms, under OCGA 9-11-67.1
  • Conduct legal research to ensure compliance with statutory updates and evolving case law interpretations
  • Draft and send timely demand responses, ensuring accuracy and adherence to legal standards
  • Communicate with insurance adjusters and claimants' counsel, providing guidance and addressing settlement-related questions
  • Monitor and track deadlines, ensuring all responses, follow-ups, and approvals are handled in a timely manner
  • Follow up on outstanding releases and settlement documentation to facilitate case closure
  • Effectively utilize support staff to ensure tasks are completed efficiently
  • Adapt to new policies, procedures, and workflow changes necessitated by firm growth
  • Remain abreast of legislative updates and evolving case law interpretations, ensuring compliance with OCGA 9-11-67.1 and other relevant legal standards
  • Take on additional responsibilities as assigned, demonstrating flexibility in a high-growth, rapidly evolving environment

Qualifications

  • Active license to practice law in Georgia
  • 1+ years of experience in insurance defense, claims handling, or civil litigation, with exposure to pre-suit settlements preferred
  • Familiarity with OCGA 9-11-67.1 or ability to quickly develop expertise
  • Strong analytical skills, with the ability to assess risk and evaluate settlement demands effectively
  • Impeccable detail orientation, organizational skills, and communication skills
  • Ability to work efficiently in a fast-paced environment and adapt to changing processes and procedures
